U.S. Consular Processing Attorneys
All non-immigrant visa stamps placed in a passport must be done by appointment at a United States embassy or consulate. This process — called “consular processing” — is mandatory if foreign travel is ever needed, even if an initial application is approved by the stateside immigration service, or if the beneficiary/applicant is applying from outside the U.S. Unfortunately, consular processing can be a difficult and frustrating experience. In many cases, an attorney's intervention may be necessary to complete or expedite the process.
At Teplen & Associates, our lawyers offer a great deal of experience working with U.S. embassies and consulates abroad, working with the U.S. State Department itself and working directly with members of Congress in order to achieve results.
We also understand that consular processing can be difficult to go through alone. While we can provide quality advice and services via the Internet or modern telecommunications equipment, we are also willing to travel anywhere in the world to represent and assist you in person.
Advantages and Disadvantages
The advantages and disadvantages to consular processing are as follows:
ADVANTAGES:
- The average time it takes for an individual to go through the consular processing process is generally less than what it would take to pursue adjustment of status in the U.S.
- Consular Processing for individuals who wish to become lawful permanent residents is available for many individuals inside and outside the United States.
DISADVANTAGES
- If a problem should arise during consular processing, there is the risk that an individual could be refused entry into the United States.
- Individuals who pursue consular processing are not eligible for employment authorization unless previously authorized in conjunction with the terms of a non-immigrant stateside-issued visa.
- Attorney representation, during an interview, is not clearly authorized as part of this process and is in the discretion of the consular officer and subject to the rules of the individual consulate.
